Musk’s X Corp. and SpaceXAI move to dismiss claims against Apple

Claims against OpenAI will remain active in the case.

X Corp. and SpaceXAI LLC, both led by Elon Musk, are seeking to end their claims against Apple Inc. in their federal lawsuit after the parties resolved those claims, according to a court filing dated Sept. 14. The companies asked the Northern District of Texas to dismiss the claims and said Apple does not oppose the request.

The companies said the dismissal applies only to Apple and does not affect their claims against OpenAI Foundation, OpenAI L.L.C. and OpenAI OpCo LLC. The filing therefore leaves the claims against the OpenAI entities pending in the case.

X Corp. and SpaceXAI also filed a proposed order for the court to approve the dismissal of their claims against Apple. If granted, the order would formally remove Apple from the case.
